DJ Responsibility: The above artist(s) are independent contractors and assume all responsibility for this contract including (but not limited to) tax, social security liability and workers compensation. In the case of a personal, family or other emergency, the above artist will notify the client and provide a replacement entertainer to perform at the event if time allows. The above artist has authorized Lakeside DJs. to sign in their behalf for any contractual agreement necessary for the performance of this engagement as outlined herein.
Limitation of Liability: Damages arising from a breach of this contract are difficult to ascertain at the time of its execution. Therefore, if the contractor or Lakeside DJs should be found liable for any failure to perform any of its obligations, their liability shall be limited to a sum equal to the total paid by Client under this contract, as liquidated damages. This remedy shall be exclusive and shall apply if loss or damage, irrespective of cause or origin, results directly or indirectly to persons or property from performance or non-performance of any of contractor’s or Lakeside DJs obligations or from negligence, active or otherwise, of contractor, Lakeside DJs, their employees or agents. Except as stated above, Client waives and releases any claims it may have against the contractor and Lakeside DJs, and agrees to indemnify and defend contractor and Lakeside DJs against any third-party claims of any nature whatsoever to the fullest extent allowed by law.
Dinner: If DJ services are to be performed at the reception, dinner must be provided by the Client for DJ(s). Damage by Client or Guests: Client shall reimburse the DJ for the cost of replacing any DJ equipment as a result of damage by Client or Clients’ guests.
Cooperation: The parties shall cooperate and communicate for the best possible results. Additionally, Lakeside DJs relies upon the hall/venue for power. It is the clients’ responsibility to ensure a power source is available for the DJ.
Exhibition: Client grants Lakeside DJs permission to display selected images resulting from this assignment as an example of work, on social media and for entrance into DJ competitions and releases all claims to profits that may arise from use of images.
Model Release: The Client hereby grants to DJ and to Lakeside DJs, and assigns, the irrevocable and unrestricted right to use and publish photographs and/or video images of the Client or in which the Client may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Client hereby releases DJ and Lakeside DJs, and assigns, from all claims and liability relating to said photographs and/or video images. Client shall notify all guests that if such guests do not want their images to appear in any promotional piece, Lakeside DJs must be notified at the event or promptly thereafter so that he or she can take steps to protect that guest’s privacy.
Opt-In Mailing: I give Lakeside DJs permission to email me occasionally and understand that they will never sell or disclose my email address to anyone else.
Entire Agreement: This agreement contains the entire understanding between the contractor and Lakeside DJs and the Client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, this does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.
Retainer: All retainers are non-refundable. If services cannot be performed for whatever reason pursuant to this Agreement, the entire amount of the retainer paid by the Client will be refunded.
Balance: The remainder of the balance is due at the beginning of the event. Any monies owed for additional products or services must be paid in full prior to the start of the event. All cancellations within 30 days of the event are subject to 50% of the contracted price. All cancellations must be provided in writing from the email address on file or through USPS.
Expenses: The Client is responsible for all travel, accommodation, and meal costs unless provided by the Client. In the event of cancellation or breach of contract by Client, Client shall reimburse any material charges incurred up to the time of cancellation.
Outdoor Events: The client shall provide overhead shelter for setup area. The DJ reserves the right, in good faith, to stop or cancel the performance should the weather pose a potential danger to him/her, the equipment, or audience. Every effort will be made to continue the performance. However, safety is paramount in all decisions. The DJ’s compensation will not be affected by such cancellation. This agreement is subject to the terms and conditions attached to this contract. I have read and understood the terms and I hereby agree to the terms as stated.
